Shipping quotes for the forwarding of Goods are provided to customers at the time of shipment request, with prices calculated in real time by the third-party provider. All shipping and forwarding fees generated through this integration are the sole responsibility of the customer and must be paid in full prior to the dispatch of any Goods. CardPort UK does not assume liability for the accuracy or timeliness of these quotes or for the performance of the third-party forwarding service.
4.8 Customers acknowledge and accept that CardPort UK utilises third-party UK-based delivery forwarding providers for the shipment of Goods upon customer request. Accordingly, customers expressly accept all risks associated with the delivery forwarding process, including but not limited to delays, lost parcels, damage in transit, customs processing, or third-party service errors. Any concerns or disputes relating to delivery after Goods have been transferred to the forwarding service must be raised directly with the relevant shipping provider; CardPort UK is not responsible for resolution or compensation after handover.
5 Delivery and Returns
5.1 Delivery of Goods is coordinated through CardPort UK’s integration with a third-party UK delivery forwarding service. Delivery times and costs are dependent on the customer’s chosen delivery option and are confirmed at the point of shipment request.
5.2 CardPort UK shall inform customers of estimated dispatch timelines and any delays via email or dashboard notification. Actual delivery dates may vary and are contingent on the performance of the third-party provider and other circumstances outside CardPort UK’s control.
5.3 Orders will be shipped to the delivery address provided by the customer at the time of order placement. CardPort UK is not liable for errors or omissions in provided shipping information, nor for delays, loss, or damage arising from incorrect address details.
5.4 Ownership and risk in the Goods pass to the customer upon dispatch from the central port repository to the delivery service. CardPort UK is not responsible for any loss, damage, or delay that occurs after transfer of Goods to the third-party forwarding service.
5.5 If the customer believes Goods have been lost, damaged, or delivered incorrectly, they should notify CardPort UK within 24 hours of delivery to provide the necessary support and evidence. Failure to notify within this timeframe may affect eligibility for support or investigation.
5.6 Returns and cancellations will be processed according to CardPort UK’s published return policy and consistent with applicable UK law. Customers wishing to initiate returns, cancellations, or disputes should contact CardPort UK via the helpdesk with details of their request.
5.7 Customers are responsible for all return shipping costs unless Goods are shown to be defective or not as described.
6 Consumer Rights and Limitation of Liability
6.1 Nothing in these Terms & Conditions excludes or limits CardPort UK’s liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable UK law.
6.2 Customers’ statutory rights under UK consumer protection laws, including the Consumer Rights Act 2015, remain unaffected. In cases of conflict between these Terms & Conditions and your statutory rights, your statutory rights will prevail.
6.3 To the maximum extent permitted by law, CardPort UK excludes liability for any indirect, special, or consequential loss or damage arising out of or in connection with the use of its platform, Goods, or Services—including without limitation: loss of profits, revenue, data, or business opportunity, whether direct or indirect, and any loss or damage caused by delays, non-delivery, or errors in shipment, except in cases of deliberate misconduct or gross negligence by CardPort UK.
6.4 CardPort UK’s total aggregate liability to any customer in respect of any and all claims arising out of or in connection with these Terms & Conditions, Goods, or Services (whether in contract, tort (including negligence), breach of statutory duty or otherwise) shall not exceed the total fees paid by the customer in the twelve (12) months preceding the event giving rise to the claim.
6.5 CardPort UK will not be liable for failing to perform or for delays in the performance of any obligation under these Terms & Conditions where such failure or delay is caused by events beyond reasonable control, including but not limited to third-party carrier failures, natural disasters, strikes, actions of third parties, or government restrictions.
6.6 Except as explicitly stated in these Terms & Conditions, all warranties, conditions, and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded.
6.7 Customers are responsible for ensuring their Goods comply with all relevant laws and regulations (including customs and import/export formalities). CardPort UK accepts no liability for loss, delays, or penalties resulting from non-compliance.
6.8 As CardPort UK contracts are concluded at a distance (online), customers have the right to cancel this Contract within 14 days of account creation without giving any reason, in accordance with the Consumer Contracts Regulations 2013.
6.9 To exercise this right, customers must inform CardPort UK via the helpdesk or email support within the 14-day period.
6.10 If items have already been received at the repository and services performed at the customer’s express request during the cooling-off period, CardPort UK may retain a proportionate amount to cover services already provided based upon the fees listed on our website.
6.11 Customers are strongly advised to arrange their own insurance for Goods stored at the central port repository. CardPort UK does not automatically insure customer Goods.
6.12 Parcel insurance for shipments is available to customers and is based on the declared value of each shipment at the time of forwarding request. Details of the standard insurance cover and the insured value offered by forwarding services will be explicitly provided before shipment confirmation. Once Goods and packaging have been collected by the designated forwarding provider, CardPort UK’s liability ceases. Any disputes or claims for loss, damage, or delay arising after collection must be pursued directly with the forwarding service and handled according to their insurance and claims procedures. CardPort UK remains liable for the care and packaging of Goods
until the point of collection but does not accept liability for any loss or damage occurring after handover. For detailed insurance coverage, exclusions, and claims process, customers should consult with the delivery forwarding provider prior to shipment request.
6.13 Where customers choose not to insure their Goods, CardPort UK’s liability is limited as set out in Section 6 (Consumer Rights and Limitation of Liability).
6.14 Customers acknowledge that certain high-value items like rare trading cards or memorabilia may require specialist insurance, and CardPort UK recommends obtaining appropriate valuation and cover.
6.15 CardPort UK shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control (“Force Majeure Events”), including but not limited to: acts of God, natural disasters, pandemics, fire, flood, strikes, war, terrorism, government restrictions, third-party carrier failures, or power failures.
6.16 Upon occurrence of a Force Majeure Event, the affected party shall notify the other party promptly (within 7 days) and describe the nature and expected duration of the event.
6.17 Performance of obligations affected by the Force Majeure Event shall be suspended for the duration of the event. The affected party shall use reasonable efforts to mitigate the impact and resume performance as soon as practicable.
6.18 If a Force Majeure Event continues for more than 60 days, either party may terminate the Contract by giving written notice, without liability for breach.
